Sports Disputes Tribunal of Kenya (SDT) will, on Thursday April 27, determine whether Kenya Volleyball Federation (KVF) national elections will proceed as scheduled on Saturday April 29th.
This, against a backdrop of allegations that they do not meet the federation's legal threshold with a case filed with the tribunal barely four days to the exercise.
In a bid to fast-track the dispute filed by 14 members, among them Moses Mbuthia, the SDT chairman John Ohaga directed all the parties involved to file evidence by Wednesday April 26 to enable him give a fair decision.
The matter was filed on a Certificate of Urgency by Paul Nyamodi in a Notice of Motion dated 24 April 2023 with a Supporting Affidavit of Ibrahim Efumbi sworn on 24 April 2023.
The Application was served on the Respondents on Tuesday 25 April and the matter mentioned for further directions on Tuesday 25 April.
The claimants argue that only four counties have met the legal requirements to participate in the election of National Executive Committee (NEC).
The KVF constitution requires officials elected from 47 counties participate in the election of the national office of the sport.
Further, the claimants have faulted notices to convene the elective AGM, KVF lawyer Geoffrey Lang'at has defended the move saying the Sports Registrar acted in accordance with the law.
Lang’at, who has filed a preliminary objection to the case filed by the claimants says the Ohaga-led tribunal lacks jurisdiction to entertain the case.
